Will Obama's First Pardons be Spy Pardons?

Today, the media are alive with reports that a spy trade / swap may be in the works - between the United States and the Russia. It is possible that, should such a trade take place, President Obama may grant 1) preemptive conditional pardons - for those recently arrested, but not yet formally convicted - and/or 2) conditional commutations of sentence - for those who are in prison as the result of trial and conviction. The"conditions" in each circumstance would, of course, be that the recipients are to be returned to Russia and that they are never to return to the United States.
